ARCTIC ELEVATION® PRIVACY POLICY

Arctic Elevation (“Arctic Elevation,” “Company,” “we,” “us,” or “our”) respects your privacy and is committed to protecting it through this Privacy Policy. This Privacy Policy describes how we collect, use, disclose, retain, and protect information when you:
1. visit or interact with our websites, mobile applications, and online services that link to this Privacy Policy (collectively, the “Technology Services”); and/or
2. book, purchase, or receive services at Arctic Elevation corporate locations or independently owned and operated franchise locations (collectively, the “Services”).
As used in this Privacy Policy, “Arctic Elevation” may include our affiliate, Arctic Franchising, LLC, as applicable. If you do not agree with this Privacy Policy, do not use our Technology Services or Services.
1. IMPORTANT FRANCHISE NOTICE
Many Arctic Elevation locations are independently owned and operated franchises. Privacy practices may vary by location based on local operations and legal requirements.
When you engage with a specific location, that location may act as a separate business that collects and uses information for its operations.
Certain systems (e.g., centralized booking, membership platforms, marketing tools) may be provided by or shared with Arctic Elevation and/or service providers supporting the brand and its locations.
Where required, the location you visit may provide additional notices (including medical privacy or consumer health data notices) that apply to you.
2. INFORMATION WE COLLECT
We collect information in three main ways: (A) directly from you, (B) automatically through technology, and (C) from third parties.
A. Information You Provide
Depending on how you interact with us, we may collect:
Identifiers & Contact Info
Name, email, phone number, mailing address, date of birth (where needed for services), account login credentials.
Scheduling & Transaction Data
Appointment history, service selections, memberships, package purchases, payment status, and related records.
Note: Payment card data is typically processed by a third-party payment processor; we may receive limited payment-related information (e.g., last four digits, tokenized payment data, billing status).
Health-Related Information (Consumer Health Data)
Information you provide in intake or screening processes (e.g., allergies, contraindications, health history, weight loss program data, treatment preferences), and other wellness-related details you choose to provide. This may be considered “consumer health data” under certain state laws even if it is not “PHI” under HIPAA.
Communications
Messages sent through forms, email, chat, phone recordings (where permitted), SMS, social media interactions, and customer support inquiries.
Photos/Media (If You Choose to Provide)
Before/after photos, profile photos, testimonials, or other content you submit.
B. Information Collected Automatically
When you use our Technology Services, we may collect:

We do not use consumer health data for advertising in ways prohibited by law and we restrict use of health-related information to what is necessary to provide requested services unless we have consent or another lawful basis.

We and our service providers may use cookies and similar tools to operate our Technology Services and to understand usage.

If you provide your mobile number and opt in, we may send you appointment-related texts and, if separately opted in, promotional texts.

Mobile Information Sharing Commitment (Important)
We do not share mobile phone numbers or SMS opt-in consent information with third parties or affiliates for their own marketing or promotional purposes. Text messaging originator opt-in data and consent will not be shared with any third parties, except with aggregators and providers of text messaging services necessary to deliver messages.
7. CONSUMER HEALTH DATA
Some information you provide such as intake details, contraindications, weight loss program details, or treatment selections may be regulated as consumer health data under certain state laws. Where applicable, we will:
Provide required disclosures about collection and use of consumer health data
Obtain consent where required before collecting or sharing certain consumer health data
Provide rights to access and delete consumer health data (subject to lawful exceptions)
Not “sell” consumer health data without legally required authorization (where applicable)
Not use prohibited geofencing practices around healthcare facilities for data collection or advertising where restricted by law
8. HIPAA & MEDICAL PRIVACY
Arctic Elevation includes franchised locations and service models that may vary.
Some locations and/or clinical partners may be subject to HIPAA or state medical privacy laws depending on how services are delivered and documented.
If HIPAA applies to a specific location or provider, you may receive a separate HIPAA Notice of Privacy Practices.
Important: Not all communications through the Website (including standard email and web forms) are secure or HIPAA-compliant. Please do not submit highly sensitive medical information through unsecured channels unless specifically instructed through a secure portal.
9. YOUR PRIVACY RIGHTS & CHOICES
Depending on your state of residence, you may have rights to:
Access information we hold about you
Correct inaccurate information
Delete information (subject to exceptions)
Obtain a copy / portability
Opt out of targeted advertising and certain disclosures defined as “sale” or “sharing”
Limit use/disclosure of sensitive information (where applicable)

Other States (Including CO, CT, VA, FL and others)

We retain information as long as reasonably necessary to:

12. CHILDREN’S PRIVACY
Our Technology Services are not intended for children under 13, and we do not knowingly collect personal information from children under 13 without verifiable parental consent. If we learn we have collected such information, we will delete it.
13. THIRD-PARTY LINKS
Our Technology Services may link to third-party websites or services. We are not responsible for their privacy practices. Please review third-party policies before providing information.
14. INTERNATIONAL USERS
Our Technology Services are intended for use in the United States. Information may be processed and stored in the United States. If you access our Technology Services from outside the U.S., you consent to this processing and storage.
